THE MAINTENANCE & WELFARE OF PARENTS & SENIOR CITIZENS ACT, 2007
The Maintenance and Welfare of parents and Senior Citizens Act, 2007 is a remarkable act, which provides for maintenance and welfare of parents and senior citizens and ensures maintenance for their livelihood.
 

Maximum Maintenance Allowance: The Tribunal (SDMs) can award maximum maintenance allowance of Rs. 10,000/- per month (Clause 14 of the Rules)
 

Application for Maintenance: Application for maintenance may be made to the Tribunal by a Senior Citizen or any other authorized representative. The Tribunal Magistrates can take suo motu cognizance.

Transfer of property to be void in certain circumstances: The Act gives protection to the senior citizens transferring their property by way of gift or otherwise his property subject to the condition that the transferee shall provide the basic amenities and basic physical needs to the transferor, if he refuses or fails to provide them, all such transfers can be declared as void if they are made as a result of fraud or coercion.

Exposure & Abandonment of Senior Citizen: Whosoever abandons any senior citizens, having care or protection of such person can be punished with a term which may extend to three months or fine which may extend to Rs. 5000/- or with both (Clause 24 of the Act)
 

Jurisdiction of Civil Courts Barred: The Jurisdiction of Civil Courts is barred to entertain any matter pertaining to this act.

Duties & Powers of the District Magistrate: The District Magistrate shall act as the appellate authority. He will ensure that the provisions of the act are carried out properly.

Duties & Powers of the SSP: Senior Superintendent of Police is bound to protect the life and property of senior citizens (Rule 20)
